Terms of Use

These Terms of Use govern your use of ChopperRadar, including chopperradar.com, its live map, and its alerts (together, the "Service"). ChopperRadar is operated by William Fitch ("we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service is

ChopperRadar shows the approximate positions of police, news, fire, medical and military aircraft, using flight data broadcast publicly by the aircraft themselves (ADS-B) and collected by third-party receiver networks. It also offers alerts based on our own automated analysis of that data. The Service is provided for entertainment and general information only.

2. Not for emergencies, safety, or navigation

Do not rely on the Service for any emergency, personal safety, law enforcement, legal, or navigation purpose. Aircraft data may be late, incomplete, inaccurate, or missing. Many aircraft do not broadcast or are filtered from public feeds. Labels, alerts, and descriptions such as "pursuit" are automated guesses and are often wrong. If you have an emergency, call 911.

3. Lawful use only

You agree not to use the Service to:

• interfere with, evade, obstruct, or endanger any police, fire, medical, or other emergency operation, or any person involved in one;
• follow, locate, harass, or stalk any person;
• violate any law;
• copy, scrape, resell, or redistribute the Service or its data, or build a competing service from it;
• share your account or let others use your login;
• probe, attack, overload, or try to gain unauthorized access to the Service or its systems.

We may suspend or close any account that we believe has broken these rules, without notice.

4. Your account

You must be at least 18 years old to create an account. Give us a real email address and keep your password private. You are responsible for activity under your account. Tell us at jafo@chopperradar.com if you think someone else has used it.

5. Free trial and paid plans

The Service is currently free. If we offer paid plans, the price, billing period, free trial, and cancellation terms will be shown to you before you subscribe, and you will not be charged unless you choose a paid plan and give a payment method. Subscriptions renew automatically until you cancel. You may cancel at any time; cancellation takes effect at the end of the period already paid for, and we do not give refunds for partial periods unless the law requires it. We may change prices for future periods with advance notice by email.

6. Changes to the Service

We may add, change, or remove features, cities, or data sources, or stop the Service, at any time. The Service may be unavailable at times for maintenance, outages, or reasons beyond our control.

7. Ownership

The Service, its software, design, labels, analysis, and content belong to us or our licensors. We give you a personal, non-transferable, revocable permission to use the Service for your own non-commercial use, subject to these Terms. Flight data comes from third-party sources and remains subject to their terms.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ITS DATA OR ALERTS WILL BE ACCURATE, TIMELY, COMPLETE, OR UNINTERRUPTED.

9. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR RELIANCE ON THE SERVICE OR ITS DATA OR ALERTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND $50.

10. Indemnity

You agree to defend and hold us harmless from any claim, loss, or expense, including reasonable attorney fees, arising from your misuse of the Service or your violation of these Terms or of any law.

11. Ending your use

You may stop using the Service and ask us to delete your account at any time by emailing jafo@chopperradar.com. Sections 8 through 12 survive the end of your use.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Service will be resolved in the state or federal courts located in California, and you and we consent to their jurisdiction, except that either party may bring an individual claim in small claims court.

13. Changes to these Terms

We may update these Terms. If a change is material, we will tell you by email or on the Service before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.
